Scope; Third Party Sites.  This Privacy Policy applies only to information we collect at and through the Service.  The Site or App may also contain links to third party sites that are not owned or controlled by Company.  Please be aware that we are not responsible for the privacy practices of such other sites.  We encourage you to be aware when you leave the Site or App and to read the privacy statements of each and every website that collects personal information.

Information You Provide to Us

We collect information you provide to us, for example when you create or modify your account, register to use the Site or App, purchase Services from us, submit a shift posting, respond to a shift posting, request information from us, contact customer support, respond to Company requests for information, or otherwise communicate with us. This information may include:

    • User generated content (for employees of Company: personal biography, employment history, shift availability, photographs, comments, and social media posts; for businesses using our Services: shift description, description of business, photographs, comments, and social media posts)

Information We Collect Through Your Use of the Service 

We collect certain information automatically as you use the Service, such as:

    • IP address
    • Browser type
    • Computer or device type
    • Unique device identifier/number
    • Operating system
    • Referring Universal Resource Locator (URL)
    • Time and date accessed
    • Pages viewed
    • Name of Internet Service Provider (ISP)
    • Location/geo-location
    • Persistent cookies

We use third-party analytics tools (including Google Analytics, which is described in more detail below) to help us measure traffic and usage trends for the Service. These tools collect information sent by your device or our Service, including the web pages you visit, add-ons, and other information that assists us in improving the Service. We collect and use this analytics information with analytics information from other Service users so that it cannot reasonably be used to identify any particular individual Service user.

Information We Collect Automatically Through Your Use of the Site or App

Google Analytics

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect certain information relating to your use of the Service. Google Analytics uses “cookies”, which are text files placed on your computer or mobile device, to help the Site and App analyze how users use the Service. Information Collected Through Cookies and Similar Technologies

We and our service providers use cookies, web beacons, and other technologies to receive and store certain types of information whenever you interact with the Service through your computer or mobile device. A cookie is a small file containing a string of characters that is sent to your computer or mobile device when you visit a website. When you visit the Site or App again, the cookie allows the Site or App, as applicable, to recognize your browser. Cookies may store unique identifiers, user preferences and other information. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Service features or Services may not function properly without cookies. No Information from Children Under Age 18

  1. HOW WE USE AND SHARE YOUR INFORMATION

To Provide Services and Information.  We collect information from you in order to provide Services that you may utilize; register and service your account; provide information that you request from us; facilitate the posting and filling of shifts through the Service; send you newsletters, promotional materials or advertisements about our Services, as well as new features and offerings; administer surveys, sweepstakes, promotions and contests; improve, test and monitor the effectiveness of the Service; develop and test new Services and features; diagnose or fix technology problems; and protect the security and integrity of the Service and Company’s business.

Sharing with Third Parties.  We may provide information to third party service providers that help us operate and manage the Site and App, process transactions for filling shifts through the Service, and advertise, market or promote Company’s Services. These service providers will have access to your personal information in order to provide these services, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the Service. We may share your personal information with third parties who may contact you about their products and services that may be of interest to you. We may also remove parts of data that can identify specific Service users and share the remaining aggregated anonymous/de-identified data with other third parties to use for analytical purposes.

Social Media Content and Publicly Available Information.  Any user generated content that Service users voluntarily disclose for posting to Company will become available to the public. Service users may limit public access to such content by adjusting the privacy settings associated with their user account.  Once a Service user shares user generated content or has otherwise made it public using the Site or App, such content may be re-shared and disseminated by other Service users and third parties.

If Service users remove information that has been posted to the Site or App, copies of such information may remain viewable in cached and archived pages of the Site or App, and may remain available to any other Service users or third parties who have copied or saved such information.

Advertising.  We may use how you interact with the Service in order to show you ads for Company or our advertising partners that are more relevant to your interests. We may use cookies and other information to provide relevant interest-based advertising to you. Interest-based ads are ads presented to you based on your browsing behavior in order to provide you with ads more tailored to your interests. These interest-based ads may be presented to you while you are browsing the Site, App or third-party sites not owned by Company.

We belong to ad networks that may use your browsing history across participating websites to show you interest-based advertisements on those websites. Currently, the Site and App do not recognize if your browser sends a “do not track” signal or similar mechanism to indicate you do not wish to be tracked or receive interest-based ads. You cannot opt-out of receiving interest-based ads from us at this time. Third Party Advertising & Marketing.  From time to time, we may disclose information (including but not limited to, information from cookies, log files, device identifiers, location data and usage data) with companies who may (i) advertise, market or promote Company’s Services to you; and (ii) advertise, market or promote their own products and services to you.

Your Consent.  In addition to the sharing described elsewhere in this Privacy Policy, we will share personal information with companies, organizations or individuals outside of Company when we have your consent to do so.

Legal Proceedings.  We will share personal information with third party companies, organizations or individuals outside of Company if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

  • Meet any applicable law, regulation, subpoena, legal process or enforceable governmental request.
  • Enforce applicable Terms of Use, including investigation of potential violations.
  • Detect, prevent, or otherwise address fraud, security or technical issues.
  • Protect against harm to the rights, property or safety of Company, our users, customers or the public as required or permitted by law.

Transfer in the Event of Sale or Change of Control.  If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business, Site or App to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.

You can close your account by electing to delete your account in the profile settings.  If you close your account, we will no longer use your account information or share it with third parties.  We may, however, retain a copy of your information for backup, archival and/or audit purposes.

  1. SECURITY OF YOUR INFORMATION 

We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your personal information, including SSL, firewalls, password protected areas of the Site and App, encryption, fraud and ID theft protection, and confidentiality agreements with employees and third parties.  However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us.  There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.  It is your responsibility to protect the security of your login information.  Please note that emails and other communications you send to us through the Site or App are not encrypted, and we strongly advise you not to communicate any confidential information through these means.

  1. CALIFORNIA PRIVACY RIGHTS

Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g. requests made in 2018 will receive information regarding 2017 sharing activities).

We will provide the requested information to you at your email address in response. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response.

  1. CONSENT TO PROCESSING OF PERSONAL DATA IN UNITED STATES

If you are a resident of the European Economic Area (EEA) or other jurisdiction outside of the U.S., in order to provide the Service, Site and App to you, we may send and store your personal information (also commonly referred to as personal data) outside of the EEA, including to the United States. Accordingly, your personal information may be transferred outside of the country where you reside or are located, including to countries that may not or do not provide the same level of protection for your personal information.  We are committed to protecting the privacy and confidentiality of personal information when it is transferred. Where such transfers occur, we take appropriate steps to provide the same level of protection for the processing carried out in any such countries as within the EEA to the extent feasible under applicable law. By using and accessing the Site and App, users who reside or are located in countries outside of the United States agree and consent to the transfer to and processing of personal information on servers located outside of the country where they reside, and that the protection of such information may be different than required under the laws of their residence or location.
